1. Acceptance of terms
By accessing or using Wapai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Wapai Ltd.
2. Description of service
Wapai provides a WhatsApp AI assistant platform that enables businesses to automate customer communication via the WhatsApp Business API. The Service includes AI-powered messaging, order management, customer intelligence, broadcast messaging, and analytics.
We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
3. Account responsibilities
- You must provide accurate information when creating your account
- You are responsible for maintaining the security of your login credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised use of your account
- One account per business — you may not share accounts
- You must be 18 or older to use the Service
4. Acceptable use
You agree not to use Wapai to:
- Send spam, unsolicited messages, or bulk communications not permitted by WhatsApp policies
- Transmit illegal, harmful, or offensive content
- Collect data about individuals without their consent
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorised access to any part of the Service
- Violate any applicable law or regulation

5. Payment terms
- Plans are billed monthly in advance
- All prices are in GBP and exclusive of VAT where applicable
- Your 14-day free trial begins on signup — no payment card required
- After trial, you will be charged on your chosen plan unless you cancel
- Payments are processed securely by Stripe
- We reserve the right to change pricing with 30 days' notice

6. Intellectual property
Wapai and its original content, features, and functionality are owned by Wapai Ltd and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written consent.
You retain ownership of the content you create using Wapai (e.g., your catalogue, FAQs, message templates). By using the Service, you grant us a licence to process that content solely to provide the Service.
7. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranty of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for indirect, incidental, or consequential damages
- Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim
Nothing in these terms limits our liability for fraud, death, or personal injury caused by negligence.
8. Termination
You may cancel your account at any time from the Settings page or by emailing support@wapai.com.
We may suspend or terminate your account if you breach these terms, fail to pay, or use the Service in a manner that harms other users or the platform.
Upon termination, your data will be retained for 30 days after which it will be permanently deleted.
9. Governing law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
